  • without the consent of the Owner, nor in time of war,
  • but in a manner to be prescribed by law.
  • Also defends right to privacy

Description of Amendment

  • Quartering Acts of 1765 and 1774
  • "Every man's home is his castle." -William Pitt
  • Citizen preferred over Soldier
  • Enforced: Peacetime and during civil unrest
  • Example: Violent Protests in Ferguson, MO

  • Citizens
  • National Guard, Police, and all other military forces
  • The legislature (Under certain circumstances)
