Schools must maintain a system of documents that are proof to suspect disability as the potential need for SPED. When they have reason to believe the student has a disability and a resulting need for special education service, schools must evaluate the child within a reasonable time to meet IDEA 2004’s requirements and avoid exposure to child-find legal challenges and compensatory service claims exposure.

Congress suspected the increase of SPED was preventable. Their suspicion about early intervention was it prevents the need for services. As we implement interventions and focus on this scientific research based practice these questions linger. at what point do we refer to sped while receiving interventions and how long do we wait to refer and so on program length.

Do students fall into the Child Find Law if they make some improvements and still show academic difficulties?

How do schools avoid child find claims while providing interventions?


We start by involving the parent in the RtI decision process and working collaboratively for the best interest of the student.

Although IDEA is finally reauthorized, there is not a comprehensive plan to immediately implement RtI. It starts as soon as possible.

Federal Funding has been shifted for RTI in programs such as ESSA, so we must document what interventions are being given and what is successful to be accountable for funding. Parents also are to be involved in the progress and decision making.

As a department we needed to discuss the RtI process. We gained guidance to better implement the lengthy implementation of a RtI program. I felt there was a need for better organization of the referral process to ensure documentation and logical steps to providing response to needs of students so that all students reach high levels of learning.
