PRESENTATION OUTLINE

AMENDMENT 5

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb, nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

The Amendment was made in reaction to the British court system. The accused couldn't prove that they were innocent. The court believed that was not sufficient. The accused could only say confessions.

The 5th amendment will not deprive citizens of life, liberty, and property without due process of law. Citizens can not be tried twice for the same felony.

There are not many issues with the amendment. If there are they are not a big deal. Most are people accused of doing something illegal and they won't talk because the 5th amendment will protect that.

The 5th amendment was included in the bill of rights. It was ratified in 1791.

The fifth amendment gave accused a right to due process. The government can not take away anything from the accused unless he or she is guilty.

So yes this did change American culture.

The amendment indeed solved the problem that it was addressed to. It gave people a fighting chance and more protection from cruel punishment.

Anyone and everyone who has been convicted of a crime has some way shape or form been involved with the 5th amendment.
