THE YCJA

BY JORDAN FLECK

The Crime
Committed by 15 year old Jack Jangles. He has a father stuck in jail and a marijuana smoking mother that neglects him. The purpose of the crime was to steal enough money to bail his father out of jail.

The Day of the Crime
Jack walks into a jewellery store, points his mothers pistol at the store clerk and tells them to give him all their money. He then takes off to his house.

After The Crime
30 minutes later, police show up at his home and he knows it's all over.

The Arrest
Police arrest Jack based on his crime. They tell him his rights and take him down to the police station. A court date is assigned to him based on how serious the crime was.

Court Date
He was in a cell until his court date. His defending lawyer fought hard against the prosecutor and the Judge took into account of his crime history, which was none, looked at his past and ordered him 1 year in a correctional facility.

He served his 1 year in a correctional facility, and once he had gotten out, his mother had realized what she had done to him and decided to go to rehab for her drug problems.

Police
Determine the initial punishment for the youth. They can give them a warning that can include a letter to the young persons parents. Can refer the young person to a program for help. The crime may be serious enough or other circumstances apply to send youth to court.

Judge
Determines what type of charges the youth gets if he is found guilty in court. The Judge must take into consideration the history, attitude and circumstances of the young offender.

Youth Justice Committee
These committees exist in communities where volunteers agree to work with young offenders. These committees act on the idea that breaking the law harms everyone in the community and that the community must become involved in solutions.

Social Workers
Help individuals, families and groups to enhance their individual and collective well-being

Family
Can be supportive during this youths time. Can also determine the youths history based on family oriented events and structure.

Justice Advocacy Group
They try to solve the underlying reason for crime. They provide public education about laws and the justice system. They work with youths and adults who have broken the law to help return them to the community.

Factors that determine the Judges decision:
-What is the young persons history?
-How serious was the offence?
-What is the young persons attitude towards the offence?
-What are the young persons circumstances?

Was it fair and equitable?
I do believe that the Judge's decision was fair because if he was an adult he would have gotten a criminal record and a way harsher punishment. The judge also had to take into account all of things in the previous slide before making his/her decision .I do also believe that it was equitable because the Judge can't be bias!
The judge also has a jury which improves the fairness level by giving more input from fellow people. Also the Jury cannot know the criminal which makes it even more equitable.
