  • 5% cap

City of Portland Ordinance

  • Requires appeal process for LL
  • Residential dwellings built within the last 5 years are exempt

  • During first 6 months, may terminate with 30 days notice
  • After 6 months, 90 day notice required, and only under certain circumstances
  • LL must pay 1 month worth of rent for relocation

After 6 months, may terminate

  • For cause
  • If LL intends to make repairs b/c of safety issues
  • If LL intends to convert to non-residential use
  • If LL intends to demolish
  • If LL has accepted an offer of purchase
  • If LL or family member will occupy

If Landlord Violates HB 2004

  • Liable for 3 months' rent
  • Liable for actual damages
  • Tenant may use as defense to eviction
