Individuals with Disabilities Education Act (IDEA)

Facts

  • Passed in 1975 under Education of Handicapped Children Act
  • Name changed in 1990
  • Required by all schools

  • Intellectually Disabled
  • Multiple Disabilities

Title IX and Sex Discrimination

Facts

  • Passed in 1972, Revised 1998
  • Schools cannot enforce it, but schools must be compliant to it
  • Protects against sex discrimination

Affects..

  • Everyone!
  • No person is excluded from participation in, be denied the benefit of or be subjected to discrimination under any education program or activity receiving Federal financial assistance

Results..

  • Females who get pregnant or become pregnant are entitled to certain rights
  • Progress toward funding more female athletic scholarships
  • Progress toward equal pay in jobs between men and women
  • More fair treatment in the workplace between men and women

Teachers Should Know..

  • Everyone is protected by sexual discrimination by any state or local agency that is ED funded
  • OCR enforces, identifies and remedies sex discrimination Title IX
  • No one can retaliate against another person if they are not compliant with Title IX

Jacob Javits Gifted and Talented Students Education Act

Facts

  • Passed 1988 as part of the Elementary and Secondary Education Act
  • Not required by all schools
  • Created to support the development of talented students in US schools

Affects..

  • Students who are believed by the school to have high achievement capabilities
  • Students support their individual creative, intellectual, artistic, or leadership capacity in this program

Results..

  • Positive outcomes that have effected the school and communites
  • Students who are more knowledgable in fields not strictly related to the classroom

Teachers Should Know..

  • about the National Research Venter on the Gifted and Talented
  • Grants given to develop and expand their Gifted and Talented Programs
  • Having a program like this is an asset to the school, especially for high achieving students

Title I

Facts

  • 1965
  • Schools must qualify as a Title I school

Affects..

  • Low achieving children in highest poverty schools
  • Limited English-proficient Children
  • Migratory Children
  • Children with Disabilities
  • Indian Children

Affects..

  • Neglected Children
  • Young children in need of reading assistance
  • Delinquent Children

Results..

  • All children in a Title I school are able to receive a fair, equal and significant opportunity to high-quality education

Teachers Should Know..

  • to provide affordable alternatives for students in such schools
  • ensure all students are achieving academically by setting and reaching targeted goals
  • to close the achievement gap between high and low performing students
  • to close the achievement gap between high and low income students

Section 504 of the Rehabilitation Act of 1973 & 1974

FACTS

  • Passed 1973-1974
  • to eliminate discrimination based on disabilities
  • required by all schools that receive federal financial assistance from ED

Affects..

  • Students with Disabilities
  • Students with a record or physical or mental impairment from one or more major life activities

Results..

  • The rights of individuals with disabilities in programs that receive federal financial assistance from ED are protected
  • Students who fall in this category are not discriminated against

Results..

  • FAPE (Free Appropriate Public Education)

Teachers Should Know..

  • that "impairments" include: physiological disorder or condition, disfigurement, anatomical loss affecting specific body systems, or any mental or emotional illness that affects their learning capabilities

Teachers Should Know..

  • that "major life events" include: major changes in the functions of caring for one's self and having it affect their day-to-day living
  • the list of major life events is not exclusive and can be added onto

Lau v. Nichols

FACTS

  • Passed 1974
  • Required by all schools who are federally funded

Affects..

  • Any language minority to English
  • Students unable to understand or speak English proficiently
  • Mostly, but not limited to, those who speak Chinese, Filipino and Spanish

Results..

  • Public funds for these programs are contributed through taxpayer money
  • Programs are now placed in all schools to help those with English language deficiencies
  • Consent Decree (Master Plan) designed to create plans for non-English speaking students to learn to speak English

Teachers Should Know..

  • Students cannot graduate from 12th grade without being proficient in English
  • Meeting required language skills must be done as soon as possible as to not deaden their educational track
  • There are plans set in place to help those students learn English
