CBI USE OF POLYGRAPH

  • CBI uses polygraphs for various purposes, including screening job applicants, investigating crimes, interrogating suspects, and for internal affairs investigations

CRIMINAL POLYGRAPH TESTING

Polygraphs can be used to gauge a suspect’s reaction to specific questions, potentially suggesting whether they are being deceptive or truthful

ELIMINATING SUSPECTS

Polygraphs can narrow down the pool of potential suspects by identifying truthful and deceptive subjects

CORROBORATING EVIDENCE

Polygraph results can be used to support or refute evidence gathered during the investigation

LIMITATIONS AND ADMISSIBILITY

NOT INFALLIBLE

  • Polygraph tests are not foolproof
  • Accuracy can be affected by examiner skill, countermeasures and the individual’s physiology

COURT ADMISSIBILITY

  • Polygraph tests are not admissible in Colorado Courts
  • The pre and post polygraph interviews ARE admissible in court

Employer cannot use a threat of discharge to coerce an employee to waive their rights
