PRESENTATION OUTLINE

GEORGIA V. RANDOLPH

BY: SAMMY, BROGAN, RYAN

CASE HISTORY

  • Police called to Randolph residence
  • Husband has drug paraphernalia
  • Husband denies search of home
  • Wife grants permission
  • Husband guilty of drug posession

Janet's Argument
Janet Randolph should be given common authority to consent the search.

Scott's Argument
Not giving consent to a search should still apply even if another co-owner consents.

Court Ruling
5 - 3 in opposition to the ruling of the lower courts.

Why This Matters
If you got some "leafy greens" and your roommate consents to a search, then you're not going to go to jail as long as you don't consent to a search.
