Conditions for conflict:

  • President may only use troops under these circumstances:
  • War declaration by Congress
  • Law passed by Congress
  • National emergency caused by attack on U.S.

President's restrictions

  • 48 hours to notify Congress
  • Must withdraw after 60 days w/o Congressional approval

  • The privilege, claimed by the president, of withholding information in the public interest.

What if that 'privilege' is used to thwart an investigation of the president himself?

  • Also stated that presidents need to be free to make decisions privately, without interference.
