Negligence:

The negligence of Montwheelers evaluators is frankly discomforting. "Records show that Montwheeler was allowed to leave the hospital despite warnings from a psychologist that there was a significant risk he would attack relatives or friends." (Fraser) This Negligence leads to the death of 2 Human Beings in two separate assaults commited back to back by Mr. Montwheeler.

Much like the negligence of Montwheeler's doctors, the negligence of Nurse Ratched in "One Who Flew Over The Cuckoos Nest" also leads to death. In this case its the suicide of Billy Bibet.

Uncertainty:

Doctors of Montwheeler seemed to be in constant disagreement about what was wrong with him. Evreyone has an opinion but they can't all be right. "Dr. Octavio Choi , a board certified forensic scientist and director of Oregon State Hospital's Forensic Evaluation service" (Fraser) speaks out about Montwheelers comprehension of new concepts in a testimony given at one of his court hearings. "Usually, there’s no clear, no-brainer path...One could quibble: When he says he doesn’t know or doesn’t understand, is that reliable or not?" The opposition of several of Montwheeler's other evaluators leaves one uncertain as they propose that Montwheeler is suffering from such things as, Depression, Adjustment disorder, or PTSD.

Similar to "One Who Flew Over The Cuckoos Nest" Nurse Ratched is convinced that the people who sentenced McMurphy to the hospital were mistaken.

Criminal Injustice

Why are murder charges dependent upon sanity? This is a question Susan Harmon would have to deal with until justice was served to Anthony Montwheeler. Susan is the mother of Anita Harmon, One of the victims of Montwheeler's heinous actions. Her along with relatives of David Bates, the second victim, "told the prosecutor that it was unfair they had to wait so long for a court to weigh Montwheeler’s guilt.

Deceptiveness should not be rewarded. In "One Who Flew Over The Cuckoos Nest" McMurphy receives the same kind of special treatment that Mr. Montwheeler receives from the court system

Conclusion

Psychiatric Evaluation is by no means an exact science, but the law is. Because of this the two should not coexist. Year after year more and more criminals are faking they're way to lesser and lesser punishment, tricking courts and Psych Evaluation experts. Justice is when people pay for there wrongdoings. There is no justice for the lives that have been lost without full consequence for all, regardless of mental stability.
