TORTS ARE STATE STATUTES

Torts may be intentional

  • Assault
  • Battery
  • Defamation

Or unintentional

  • NEGLIGENCE
  • this is the most common tort against school personel

Conduct falling below a reasonable standard of care resulting to injury to another person.

  • High
  • Medium
  • Low

TYPES OF LITIGANTS:

  • Invitee (students)
  • Licensee (UPS)
  • Trespasser (not kids after school!)

Care in practice

  • Make sure it's safe (clean spills)
  • Do not increase danger (mark spills)
  • Do not be wanton (guide into spills)

IF YOU ARE NEGLIGENT,

all 4 of these will have happened
