Facilitation

  • Adds an impartial facilitator.
  • Helps move along the process when stuck.
  • Often times brings up new ideas and can mend relationships.
  • Must be agreed upon by both parties.

Negotiation

  • Meetings can be called by either the school or parent
  • Usually the first step in resolving complaints/mishaps
  • Allows both parties to come up with a solution to a problem that was found
  • No cost to district and less complicated than a due process hearing.

Mediation

  • Use of an impartial mediator to help with conflict resolution
  • Decision is legally binding
  • Mediator helps move things along and keep meetings from becoming adversarial

Due Process

  • Formal complaint filed against the district
  • Comes about when IDEA is not followed or services not offered appropriately
  • Involves legal counsel and is a formal and involved process

Relationships

  • Most disputes/due process come form a breakdown of relationship/ communication
  • Often times when the relationship is repaired resolution comes much easier
  • Always best to be proactive with school/family relationships
  • Open communication often key
