Key Idea #1

  • There are many ways in which a resolution may be solved in the case of an IEP dispute. At times, more formal methods of resolution must be utilized.

How to resolve an IEP dispute

  • Negotiating
  • Asking for a mediator
  • File a complaint for due process
  • Filing a civil lawsuit
  • Asking for an investigation through a state complaint

Key Idea #2

  • When necessary, introducing a mediator into the IEP meeting is a great way to overcome obstacles and close minds.

The benefits of IEP Facilitation

  • By encouraging communication, the facilitator opens a pathway to more effective brainstorming. In turn, this leads to new ideas and perspectives.
  • The facilitator also guides the conversation in allowing all participants to share their perspective and ideas.
  • Relationships are strengthened and improved.

What are the rights?

  • If the educational agency is unable to confirm guardian participation, they are able to ask the officer to dismiss the case.
  • If the educational agency does not hold the Resolution meeting within 15 calendar days, then guardians are able to ask the officer to begin the due process timelines.
