Eighteenth Amendment

The 18th Amendment to the United States Constitution prohibited the manufacture, sale,transport,import,or export of alcoholic beverages. Upon ratification of the amendment by the states, congress voted it's approval in October 1919, and enacted it into law as the National Prohibition Act of 1920.

History and Meaning
People believed that there was a link between alcohol and many antisocial behaviors, like child abuse and domestic violence. Also Henry Ford was concerned that alcohol had a negative impact on labor productivity.

History and Meaning
The 18th Amendment is the only amendment to be repealed from the constitution. This unpopular amendment banned the sale and drinking of alcohol in the U.S. This amendment took effect in 1919 and was a huge failure.

Hawke v. Smith 1920's
Ohio's legislature reserved the right to review the state legislature's ratification of any federal amendment. This meant that within ninety days of being ratified, the ratification could be challenged by a petition signed by six percent of Ohio voters.

Majority of Ohio voters voted against prohibition. The court ruled that Ohio voters could not overturn the state legislature's approval of the Eighteenth Amendment

Significance
This case made it clear that the 18th Amendment was valid.Secondly, the fact that the amendment passed Ohio despite a majority of voters voting against it fostered the idea that prohibition was the work of powerful groups and not the people themselves.
