THE 5TH AND 6TH AMENDMENT
The fifth amendment says that a person can deny answering questions, and the sixth is about the rights of criminals.
How would you feel if you were immediately guilty and had to testify against yourself?
5th- protects a person against being compelled to be a witness against him or herself in a criminal case. Protects the double jeaprody clause. Pleading the fifth allows a witness to decline answering questions that might incriminate him or herself. People used to be charged for the same crime twice and prevents violation of human rights.
6th amendment- sets forth rights related to criminal prosecutes. Criminals have the right to a speedy trial. In Barker V. Wingo, 407 U.S. 514 (1972), the Supreme Court laid down a four part case by case balancing test for determining whether the defendants speedy trial rights have been revoked.
This the key rights to have in our bill of rights because you have the right to not testify against yourself and a speedy trial. This helps our justice system.
