5 key ideas

  • A facilitator is helpful in keeping everyone on task and focused on the student
  • After a parent files a complaint and before the due process hearing, a mediation hearing can take place.
  • Mediation is a voluntary way to settle disputes between parents and the agency.
  • Purpose is to discuss with parents to discuss the facts that caused the due process request.
  • The resolution meeting must be held by law unless the parents agree in writing not to hold the meeting

  • Resolution meeting does not have to be held if the parents and the agency agree to use mediation to resolve the issues
