WE PROPOSE AMENDMENT 28

  • The right of the citizens to marry in the United States shall not be denied or abridged
  • by the United States or by any state in regards to gender.
  • Congress shall have the power to enforce this article by appropriate legislation.

CONSTITUTIONAL SUPPORT

  • There is no specific reference to marriage in the constitution but Article IV Section 1 states that
  • "Full faith and credit," shall be given in each state to the "public acts, Records, and judicial proceedings,
  • of every other state."
  • Other states have recognized full marriage equality and following the constitution requires the others to recognize
  • the decision.

CONSTITUTIONAL PROOF CONT

  • 14th amendment Section 1
  • The amendment states that no law of the states can deprive any
  • Person of life, liberty, or property, without due process.
  • The amendment also prohibits the denial of equal protection to any person in the state's
  • Jurisdiction.

CURRENT EVENTS

  • Gay marriage has been a major source of conflict among lawmakers and the public
  • There is a large movement to legalize gay marriage in all 50 states
  • 19 states have legalized it so far including California, Delaware, and Maine.
  • 8 have legalized it through Court Decision, 8 through State Legislature, and 3 by popular vote
  • President Obama has spoken out in support believing marriage equality "strengthens families."

CURRENT EVENTS CONT

  • In California in 2010, US District Court Chief Judge Vaughn Walker
  • declared proposition 8 a violation of the due process and equal protection
  • clauses of the US Constituion.
