• Those without healthcare must buy it from private companies
• Amount of people with medicaid will increase
• States that do not comply will loose all federal medicaid funding

• It is Constitutional to make individuals buy healthcare from private companies
• Congress has this power under the Taxing Clause
• It is Unconstitutional to deny states federal medicaid funding
• It is congress' duty to regulate interstate commerce

FEDERALISM

• Supreme Court recognizes power of State Governments
• Congress cannot force states to comply to laws nonexistent in the Constitution
• States must follow Congressional tax laws
